Welcome to the d3wa platform for designing and sending digital event invitations, a product of Digital Analytics Information Technology Company (DAITCO). These Terms of Use outline the rules and conditions governing your use of d3wa services, including the website (www.d3wa.net) and the WhatsApp invitation creation and sending system.

By using d3wa services, you agree to be bound by these Terms. If you do not agree to any part of them, please do not use the service.

Services provided

The “d3wa” platform provides an integrated platform that includes:

• Designing digital invitations for events (weddings, functions, special occasions)
• Managing guest lists
• Sending invitations via WhatsApp
• Tracking the status of invitations sent and read
• Managing responses (accept/decline)
• Providing statistics and reports on invitation interaction

Registration and usage terms

1- Registration

1. You must provide accurate and truthful information when creating an account or using the service.

2. You are responsible for maintaining the confidentiality of your login details and for all activities that occur through your account.

3. You must notify us immediately of any unauthorized use of your account.

2: Using the service

1. You agree to use the invitation services only for legitimate purposes and in accordance with these terms and conditions and the regulations applicable in the Kingdom of Saudi Arabia.

2. Using the platform to send unsolicited messages (spam) or unauthorized promotional content or content that violates WhatsApp policies is prohibited.

3. Using the service for any illegal purpose or that violates the privacy of others is prohibited.

4. Attempting to access or tamper with the platform’s systems without authorization is prohibited.

Messages via WhatsApp

1. The platform relies on services like the WhatsApp Business API to send invitations.

2. You are responsible for entering valid phone numbers and obtaining the invitees’ consent to receive messages when necessary.

3. “Invite” is not responsible for number blocking or restrictions imposed by service providers (such as WhatsApp) as a result of misuse.

The Content

User-provided content:

1. The platform allows users to create invitation content (text, images, links, designs).

2. It retains full ownership of the content submitted.

3. “Invitation” grants a non-exclusive license to use this content solely for the purpose of providing and operating the service.

4. The content must not contain any illegal, offensive, or infringing material.

Data and privacy:

1. The processing of your personal data is governed by the platform’s privacy policy.

2. You agree that your data (as a platform user) may be used for service operation and communication purposes, and may also be used for platform-specific marketing purposes only.

3. Invitee data will not be used for marketing purposes outside the scope of the invitation.

4. We may use anonymized data for analysis and service improvement purposes.

Intellectual Property

1. All intellectual property rights related to the “Da’wa” platform, including software, designs, logos, and trademarks, are owned by or licensed to Digital Analysis Information Technology Company (DAITCO).

2. Use of the service does not grant you any ownership rights in the platform or its technologies.

3. It is prohibited to copy, modify, redistribute, or sell any part of the service without prior written consent.

Disclaimer and Indemnity

Disclaimer

1. The “Invitation” services are provided “as is” and “as available” without any warranties of any kind.

   We do not guarantee that the service will be error-free or operate without interruption.

2. We are not liable for any damages resulting from the use of the platform or from delays or failures in sending messages due to third parties.

Compensation

You agree to indemnify “Da’wa” and Digital Analysis Information Technology Company (DAITCO), its employees, and agents against any claims, losses, or damages arising from:

1. Your use of the service
2. Your violation of these terms
3. Your violation of the rights of any third party
4. Your misuse of the messaging service

Amendments and termination of service

Terms Modification

1. We reserve the right to modify these terms at any time.

2. Updates will be posted on the website and will become effective immediately upon posting.

3. Your continued use of the service after modifications constitutes your acceptance of those modifications.

Termination of service

1. We may suspend or terminate your account or access to the service at any time, particularly if you violate these terms.

2. Terms that by their nature continue after termination (such as liability and intellectual property) will remain in effect.

Applicable law and dispute resolution

1. These terms and conditions are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

2. Any dispute will be resolved amicably first.

3. If no resolution is reached, the matter will be referred to the competent judicial authorities in the Kingdom of Saudi Arabia.
